This User Agreement is between Shenzhen Kaadas Intelligent Technology Co.Ltd.(hereinafter referred to as "Kaadas") and all subjects (including but not limited to individuals, teams, etc.) who use the Kaadas Smart Client (hereinafter referred to as "Kaadas") (hereinafter referred to as Users), this Agreement is a valid contract. The contract entered into by Kaadas is valid. Use of any of Kaadas' services constitutes acceptance of the terms of this Agreement in its entirety
I. General Provisions
1.1 The ownership and operation of belongs to Shenzhen Kaadas Intelligent Technology Co.Ltd.
1.2 Before registering, the User shall read this Agreement carefully and agree to comply with this Agreement before becoming a registered user. Once registration is successful, an agreement is automatically formed between the User and Kaadas, and the User shall be bound by this Agreement. When using special services or products, the User shall agree to accept the relevant agreement before using them.
1.3 This Agreement may be updated by Kaadas at any time, and the updated terms and conditions of the Agreement shall replace the original terms and conditions of the Agreement upon publication without further notice, and the User may check the latest version of the terms and conditions of the Agreement on this platform. After Kaadas modifies the terms of the Agreement, if the User does not accept the modified terms, please immediately stop using the services provided by Kaadas, and the User's continued use of the services provided by Kaadas will be deemed to be acceptance of the modified Agreement.
II.the service content and use instructions
2.1 Kaadas Smart APP should be used with Kaadas brand related products.
2.2 Kaadas Smart only provides the relevant network services, except for the equipment (such as personal computers, cell phones, and other devices related to accessing the Internet or mobile network) and the costs (such as telephone and Internet access fees paid for accessing the Internet and cell phone fees paid for using the mobile network) related to the relevant network services, which shall be borne by the user.
III. User account
3.1 Users who have completed the registration process and passed the identity authentication by Kaadas Smart Registration System become official users and can obtain all the rights that Kaadas stipulates users should enjoy.
3.2 The user shall be solely responsible for any loss or damage caused by all activities conducted by the user through the account, and Kaadas Intelligence shall not be liable for any of them. Kaadas shall not be responsible for any illegal use of the account due to hacking or the user's negligence in keeping the account.
IV. Rules of use
4.1 Users are required to comply with the relevant laws and regulations of the People's Republic of China, including but not limited to Regulations of the People's Republic of China on the Security Protection of Computer Information Systems,
Regulations on the Protection of Computer Software, Regulations on the Administration of Internet Electronic Announcement Services, Regulations on the Administration of Internet News Information Services, Measures for the Administrative Protection of Internet Copyright and Regulations on the Protection of the Right to Information Network Dissemination, and other laws and regulations and implementation measures related to computer Internet regulations and intellectual property rights.
4.2 Users are fully responsible for the content they publish, upload or transmit on their own, and all users shall not publish, reproduce or transmit information containing one of the following contents on any page of Kaadas Smart, otherwise Kaadas has the right to deal with it on its own and without notifying the user, and any loss or damage caused by it shall be the sole responsibility of the user, and Kaadas shall not bear any responsibility for.
(1) Those that violate the basic principles established by the Constitution.
(2) endangering national security, leaking state secrets, subverting state power, and undermining national unity.
(3) damage to national honor and interests.
(4) inciting ethnic hatred, ethnic discrimination and undermining national unity.
(5) undermine the state's religious policy and promote cults and feudal superstitions.
(6) spreading rumors, disturbing social order and destabilizing society.
(7)the dissemination of obscenity, pornography, gambling, violence, terrorism or abetting crime.
(8) Insulting or defaming others and infringing on their legitimate rights and interests.
(9)inciting illegal assemblies, associations, marches, demonstrations, and gatherings to disrupt social order.
(10) Activities in the name of illegal civil society organizations.
(11) Activities in the name of illegal civil society organizations.
4.3 The User undertakes to enjoy complete intellectual property rights for all information published or uploaded by the User to Kaadas Smart (i.e. works belonging to the Copyright Law of the People's Republic of China, including but not limited to text, pictures, music, movies, performances and audio and video recordings and computer programs, etc.) or has been legally authorized by the relevant right holder; if the User violates the provisions of this Article and causes Kaadas Smart to be claimed by a third party, the User shall fully compensate Kaadas for all costs (including but not limited to various compensation fees, litigation agency fees and other reasonable costs incurred in this regard). If the user violates the provisions of this article, the user shall fully compensate Kaadas for all costs (including but not limited to various compensation fees, litigation agency fees and other reasonable costs incurred for this purpose), and the user shall bear full responsibility for any loss or damage caused by this, and Kaadas shall not bear any responsibility.
4.4 When a third party believes that the information published or uploaded by the User on Kaadas infringes its rights and sends a notice of rights to Kaadas in accordance with the Regulations on the Protection of Information Network Dissemination Rights or relevant laws, the User agrees that Kaadas may decide to delete the allegedly infringing information at its own discretion, and that Kaadas will not automatically restore the above-mentioned deleted information unless the User submits written evidence to exclude the possibility of infringement.
4.5 The User warrants that the content it uploads to Kaadas Smart shall not directly or indirectly.
(1) Use of the web service system for any unlawful purpose.
(2) Interfere or attempt to interfere in any way with the normal operation of the Kaadas Smart Client or any part and function of the website of Shenzhen Kaadas Smart Technology Co.Ltd.
(3) Avoid, attempt to avoid, or claim to be able to avoid any content protection mechanism or Kaadas Smart Data Metrics tool.
(4) use any registered or unregistered work, service mark, company logo (LOGO), URL or other mark originating from Shenzhen Kaadas Intelligent Technology Co., Ltd. in a written format or graphically without Kaadas's prior written consent.
(5) request, collect, solicit or otherwise obtain from any user access to a Kaadas Smart Technology account, password or other authentication credentials.
(6) Automatic login to the Kaadas Smart Account Agent authentication credentials for any user.
(7)provide tracking capabilities, including but not limited to identifying other users viewing or operating on their personal home pages
(8) Unauthorized impersonation of others to obtain access to Kaadas Smart Technology.
4.6 If the User violates any of the above guarantees, Kaadas has the right to warn, block or even cancel the login status of the User according to the circumstances; if the User violates the above guarantees and causes damage to Kaadas, Kaadas Smart users or any partners of Shenzhen Kaadas Smart Technology Co.Ltd.
V. Privacy protection
5.1 Kaadas Smart does not disclose or make available to third parties the registration information of individual users and the non-public content stored by users in Kaadas Smart when using the Web Services, except for the following cases.
(1)Obtain prior express authorization from the user.
(2))In accordance with the relevant legal and regulatory requirement
(3)In accordance with the requirements of the relevant government authorities.
(4)To protect the interests of the public.
5.2 Kaadas may cooperate with a third party to provide relevant network services to the User, in which case Kaadas shall have the right to provide the User's registration data, etc. to such third party if such third party agrees to assume the same responsibility for protecting the User's privacy as Kaadas.
5.3 Kaadas reserves the right to analyze and commercially exploit the entire user database without disclosing the private information of individual users.
六、Copyright Notice
6.1 The copyright of the text, pictures, audio and video of Kaadas belongs to Shenzhen Kaadas Smart Technology Co., Ltd. or jointly with the author, and may not be reproduced arbitrarily without the permission of Kaadas, otherwise it will bear the relevant legal responsibility.
6.2 The copyright of the unique logo, layout and arrangement of Kaadas Smart belongs to Shenzhen Kaadas Smart Technology Co.Ltd.
6.3 Any content used by Kaadas Smart shall be indicated as "from Kaadas Smart" and signed with the author's name, and if payment is required by law, Kaadas Smart and the author shall be notified and paid, and shall independently assume all legal responsibilities.
6.4 Kaadas Smart enjoys the priority right to use all works for other purposes, including but not limited to website, e-magazine, print publication, etc., but will notify the author before use and pay the remuneration according to the standard of the same industry.
6.5 All content of Kaadas Smart represents only the author's own position and opinion, and has nothing to do with Kaadas, and the author himself shall bear all legal responsibilities.
6.6 Kaadas reserves the right to take legal action against those who maliciously reproduce Kaadas Smart Conte
VII. Statement of responsibility
7.1 The User expressly agrees that its use of the Kaadas Smart Network Service is at its own risk and that all consequences will be borne entirely by the User and that Kaadas shall not be liable in any way for it.
7.2 Kaadas cannot guarantee that the Network Services will meet the User's requirements, nor does it guarantee the timeliness, security, or accuracy of the Network Services.
7.3 Kaadas does not guarantee the accuracy and completeness of external links set up for the convenience of users, and Kaadas Smart is not responsible for the content on any web pages not under the actual control of Kaadas Smart to which such external links lead.
7.4 Kaadas shall not be liable for any defects in the quality of the following products or services provided by Kaadas Smart to the User and for any losses arising therefrom.
（1）The various network services provided by Kaadas Intelligence to users free of charge.
(2)Any product or service given to the user by Kaadas Smart.
7.5 Kaadas reserves the right to modify or discontinue the Service (or any part thereof) at any time, temporarily or permanently, with or without notice, without any liability to the User or any third party.
VIII. By-laws
8.1 The laws of the People's Republic of China shall apply to the conclusion, execution and interpretation of this Agreement and the settlement of disputes. If any dispute arises between the User and Advantage Technology regarding the content of this Agreement or its implementation, both parties shall try to resolve it amicably; if the negotiation fails, either party may file a lawsuit with the People's Court where Kaadas is located.
8.2 This Agreement shall be effective upon publication, and Kaadas shall have the right to modify the content of this Agreement at any time, and the result of such modification shall be published on the website of Shenzhen Kaadas Intelligent Technology Co. If the User does not agree with the modifications made by Kaadas to the relevant provisions of this Agreement, the User has the right to stop using the Network Services. If the user continues to use the network service, the user shall be deemed to accept the modifications made by Shenzhen Kaadas Intelligent Technology Co.
8.3 If any provision of this Agreement is for any reason invalid or unenforceable in whole or in part, the remaining provisions of this Agreement shall remain valid and binding.
8.4 Force Majeure Clause: If the inability to perform this Agreement is due to reasons beyond the foreseeability and control of a party, such as war, strike, natural disaster, bad weather, interruption of air transportation, etc., the party unable to perform this Agreement is released from liability accordingly.
8.5 The right to interpret and amend this Agreement belongs to Shenzhen Kaadas Intelligent Technology Co.Ltd.
